Commercial mediation
For a company a dispute costs twice: once through the amount at stake and once through the time the team loses over it. Commercial mediation deals with the second cost and leaves open the option of carrying on the working relationship, if both parties want that.
When mediation fits
- You have unpaid invoices from a partner you would rather not lose.
- You read the same clause differently: delivery time, quality, penalties.
- The partners cannot agree on management, on profit, or on one of them leaving.
- A long-term contract needs renegotiating, because prices or market conditions have changed.

A trial that is won usually closes the contract as well. A negotiated settlement leaves you the option of keeping the client, the supplier or the distributor.
