Family mediation
Family mediation deals with the decisions a separation leaves behind: where the children live, what the contact arrangements look like, how shared assets and debts are divided. The conversation takes place in an office, between adults, with no courtroom.
When mediation fits
- You have decided to divorce and want to set the terms yourselves, rather than have a court set them.
- You do not agree on where the children will live or on the contact arrangements.
- You have a flat, a loan or assets acquired during the marriage to divide.
- An old arrangement no longer matches reality, because a schedule, an income or an address has changed.
What you gain
The children stay out of the conflict
The conversation is between adults, in an office, not before a court. The children are not heard as witnesses and are not asked to choose between their parents.
The decisions are yours
Nobody imposes a solution on you. The contact arrangements, for example, can be built around the real schedule of the family rather than a standard pattern.
The conversation stays private
What is said in the session does not end up in a case file. The mediator cannot be heard as a witness about facts learned during mediation.

The written agreement
The points agreed are set down in a clear mediation agreement (acord de mediere), signed by both of you, which can acquire enforceable force under the conditions laid down by law.
